New York has the 'Red Flag' Law, or the extreme risk protection order (ERPO). This form allows people involved in the person's life to prevent an individual from causing harm to themselves or other by purchasing a firearm.
An ERPO can be filled out by the following people:
- A health or mental health care practitioner who examined the individual in the last six months
- A member of the same household
- A school official
- A police officer
- A district attorney.
