Does Delaware Require a Background Check to purchase a Firearm?
Yes, Delaware has a state law that requires a background check prior to the sale of a firearm.
In 2022, Delaware enacted a law that states Federally Licenced Dealers (FFLs) must contact the State Bureau of Identification of the Delaware State Police (SBI) when an individual attempts to purchase a firearm. This law is to be in effect after June 30, 2023, until than, the FBI will be the authority to conduct background checks
An FFL may not sell, transfer or deliver a firearm to another unlicensed person until the FBI/SBI notifies the dealer to proceed. However, if 25 days are passed, and there is no update than the dealer may proceed
All unlicensed dealers must request a licensed dealer to facilitate a firearm transaction by conducting a background check on the purchaser before the sale of that firearm
